GeekBeam Terms of Use

These Terms of Use ("Terms") are a binding agreement between you and GeekBeam, Inc. ("GeekBeam," "we," "us," or "our"), a Delaware corporation registered at 2810 N Church St, STE 90832, Wilmington, DE 19802, USA. They govern your use of the GeekBeam mobile application, website, and related services (together, the "Service"). By creating an account, accessing, or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

Our Privacy Policy explains how we handle your personal data and forms part of these Terms.

1. The Service

GeekBeam is a streaming service for short-form serialized video content ("Content"). Some Content is free; other Content requires a subscription, Tokens, or a one-time title purchase, as shown in the app. Content availability, pricing, and free/paid status may vary by title, region, and over time.

2. Eligibility

You must be at least 13 years old to use the Service. If you are under the age of majority where you live, you may only use the Service with the consent of a parent or legal guardian who agrees to these Terms on your behalf.

3. Your Account

You are responsible for your account credentials and for all activity under your account. Provide accurate information and keep it up to date. Notify us at info@geekbeam.tv if you suspect unauthorized use of your account. We may suspend or terminate accounts that violate these Terms.

4. Subscriptions

  • What you get. A GeekBeam subscription ("VIP") gives you unlimited access to subscription Content for as long as your subscription is active.
  • Auto-renewal. Subscriptions renew automatically at the end of each billing period (e.g. weekly, monthly, or yearly, as selected at purchase) until you cancel. The price and billing period are shown at the point of purchase.
  • Billing. If you subscribe through the Apple App Store or Google Play, payment is charged to your store account and the store's payment terms apply. If you subscribe through our website, payment is processed by our payment provider (e.g. Stripe).
  • Cancellation. You can cancel anytime. For store purchases, cancel at least 24 hours before the end of the current period in your App Store or Google Play subscription settings; the cancellation takes effect at the end of the current period. For web purchases, cancel through your account or by contacting us. You keep access until the end of the period already paid.
  • Price changes. If we change subscription prices, the change applies to your next billing period, and we will notify you in advance as required by the store or applicable law. If you do not agree, cancel before the change takes effect.

5. Tokens and One-Time Purchases

  • Tokens are a virtual, in-app balance you can use to unlock individual episodes. Tokens may be purchased in packs, granted for free (e.g. welcome balances, rewards, promotions), or included with certain offers.
  • Tokens are a limited, revocable, non-transferable license to access features of the Service. Tokens are not money, have no cash value, cannot be redeemed for cash, and cannot be transferred or resold.
  • Token prices, pack sizes, episode unlock costs, and promotional grants are shown in the app and may change over time. Changes do not affect Tokens already spent.
  • Title purchases unlock a specific title for your account.
  • Except where required by law or by the applicable store's refund policy, purchases of Tokens and titles are final and non-refundable, and unused Tokens are forfeited if your account is terminated for a violation of these Terms or deleted at your request.

6. Refunds

Purchases made through the Apple App Store or Google Play are subject to that store's refund policies — refund requests must be directed to Apple or Google. For purchases made through our website, contact us at info@geekbeam.tv; refunds are granted where required by law. Nothing in these Terms limits any non-waivable statutory right you may have.

7. License to Use the Service

We grant you a personal, limited, non-exclusive, non-transferable, revocable license to use the app and stream Content for your personal, non-commercial use. You may not:

  • copy, record, download (except where a download feature is provided), redistribute, publicly perform, or make Content available to third parties;
  • circumvent technical protection measures (including screen-capture protections), scrape, reverse engineer, or access the Service by automated means;
  • resell, sublicense, or commercially exploit the Service, Tokens, or Content;
  • use the Service in violation of applicable law.

All Content, software, and branding of the Service are owned by GeekBeam or its licensors and are protected by intellectual-property laws. No rights are granted except as expressly stated in these Terms.

8. Availability and Changes to the Service

We continuously develop the Service and may add, change, or remove features or Content at any time. We do not guarantee that any specific title will remain available. We may suspend the Service for maintenance or for reasons beyond our control.

9. Termination

You may stop using the Service and delete your account at any time (see the Privacy Policy for data deletion). We may suspend or terminate your access if you materially breach these Terms, if required by law, or if we discontinue the Service. Where the reason is a breach, termination may include forfeiture of Tokens and remaining subscription time, to the extent permitted by law.

10. Disclaimers

The Service is provided "as is" and "as available." To the maximum extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted or error-free.

11. Limitation of Liability

To the maximum extent permitted by law, GeekBeam will not be liable for indirect, incidental, special, consequential, or punitive damages, or for loss of profits, data, or goodwill, arising out of or related to the Service. Our total liability for all claims arising out of the Service is limited to the greater of (a) the amounts you paid to GeekBeam in the 12 months before the claim, or (b) USD 50. Some jurisdictions do not allow certain limitations, so parts of this section may not apply to you.

12. Indemnification

You will indemnify and hold GeekBeam harmless from claims and expenses (including reasonable attorneys' fees) arising from your breach of these Terms or misuse of the Service, to the extent permitted by law.

13. Governing Law and Disputes

These Terms are governed by the laws of the State of Delaware, USA, without regard to conflict-of-law rules, and the courts located in Delaware will have exclusive jurisdiction — except that if you are a consumer in the EU/EEA or UK, you retain the protection of the mandatory consumer laws of your country of residence and may bring proceedings there.

14. Additional Terms for Apple Users

If you access the Service on an Apple device, the following applies:

  • These Terms are between you and GeekBeam only, not with Apple Inc. ("Apple"). Apple is not responsible for the Service or its content.
  • Your license to the app is limited to a non-transferable license to use the app on Apple-branded devices you own or control, as permitted by the App Store Terms of Service.
  • Apple has no obligation to provide maintenance or support for the app.
  • In the event the app fails to conform to an applicable warranty, you may notify Apple and Apple will refund the purchase price of the app (if any); to the maximum extent permitted by law, Apple has no other warranty obligation.
  • Apple is not responsible for addressing any claims by you or a third party relating to the app, including product liability, legal/regulatory compliance, and consumer-protection claims.
  • In case of a third-party claim that the app infringes intellectual-property rights, GeekBeam, not Apple, is responsible for the investigation, defense, settlement, and discharge, to the extent required by these Terms.
  • You represent that you are not located in a country subject to a U.S. Government embargo or designated a "terrorist supporting" country, and that you are not on any U.S. Government list of prohibited or restricted parties.
  • Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.

15. Changes to These Terms

We may update these Terms from time to time. For material changes we will give notice in the app or by email before the changes take effect. Continuing to use the Service after the effective date of updated Terms constitutes acceptance. The current version is always available at https://geekbeam.tv/terms.
